Please read these terms carefully before using PianoMode services.

Welcome to PianoMode (the “Website”). These Terms of Service (“Terms”) govern your access to and use of the Website, including any content, functionality, and services offered on or through PianoMode.

Please read these Terms carefully before you start to use the Website. By using the Website or by clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the Website.


1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and PianoMode (“we,” “us,” or “our”), concerning your access to and use of the pianomode.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing the Site, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.


2. INTELLECTUAL PROPERTY & CONTENT SOURCES

PianoMode operates a “Hybrid Content Model” consisting of proprietary, public domain, and third-party materials.

A. Proprietary Content

All original video lessons, technical exercises, editorial text, blog posts, and the “PianoMode” brand and logo are the exclusive property of PianoMode. We grant you a limited, non-exclusive, non-transferable license for personal, non-commercial use only.

B. Public Domain & Creative Commons (CC) Resources

We provide access to sheet music and PDF scores that are either in the Public Domain or licensed under Creative Commons.

  • Public Domain: While the underlying music is free of copyright, any custom formatting, editorial annotations, or curated digital delivery provided by PianoMode is protected.
  • Creative Commons: Materials provided under CC licenses are subject to their respective terms (e.g., CC BY-NC). You are responsible for adhering to the specific license associated with each file.

C. Third-Party Embedded Content (YouTube)

Our Site features embedded content, specifically YouTube videos from external creators used for educational purposes (e.g., performance comparisons or score presentations).

  • Ownership: This content remains the sole property of the original copyright holders.
  • Compliance: We embed these videos in accordance with YouTube’s Terms of Service. PianoMode does not claim ownership over these external media files.

D. DMCA Notice & Copyright Infringement

We respect intellectual property. If you believe any content on our Site infringes your copyright, please notify us at [email protected] with:

  2. The specific URL of the infringing material.
  3. Your contact information and a statement of good faith.

3. AFFILIATE & ADVERTISING DISCLOSURE (FTC COMPLIANCE)

In compliance with the Federal Trade Commission (FTC) guidelines and international advertising standards, please be advised:

  • Affiliate Links: PianoMode participates in various affiliate marketing programs. This means we may earn a commission on purchases made through links to retailers including, but not limited to, Amazon, Thomann, Sweetwater, Beatport, and Virtual Sheet Music.
  • No Extra Cost: Using these links does not increase the price you pay.
  • Editorial Integrity: We only recommend products (pianos, VSTs, sheet music, etc.) that we believe add value to our students. Our recommendations are not influenced by the affiliate relationship.

4. PROFESSIONAL & RESULTS DISCLAIMER

A. No Guarantee of Results

Piano instruction is a subjective discipline. Your musical progress depends on your practice habits, prior experience, and individual aptitude. PianoMode makes no guarantees regarding your level of skill or the time required to achieve specific milestones.

B. Not Professional Advice

The content on this Site is for educational and informational purposes only. It does not constitute a formal academic degree or professional certification.


5. HEALTH & PHYSICAL SAFETY DISCLAIMER

Playing the piano is a physical activity. Improper technique or excessive practice can lead to Repetitive Strain Injuries (RSI), such as carpal tunnel syndrome or tendonitis.

  • User Responsibility: You are responsible for monitoring your own physical comfort.
  • Assumption of Risk: By using our technical exercises and practice routines, you assume all risk of physical injury. PianoMode is not liable for any injuries sustained while practicing. We strongly recommend consulting a medical professional if you experience persistent pain.

6. PAYMENTS, SUBSCRIPTIONS & REFUNDS

  • Digital Goods: Due to the immediate access nature of digital downloads (PDFs) and streaming content, all sales are final. No refunds will be issued once the content has been accessed or downloaded.
  • EU/UK Statutory Rights: If you are a consumer in the EU or UK, you waive your 14-day right of withdrawal once the digital content delivery has begun with your express consent.

7. USER CONDUCT & PROHIBITED ACTS

You agree not to:

  • Share your account credentials with third parties.
  • “Scrape” or use automated tools to download our proprietary content.
  • Resell or redistribute our PDFs or video lessons for commercial gain.

8. LIMITATION OF LIABILITY & INDEMNIFICATION

Limitation: To the maximum extent permitted by law, PianoMode shall not be liable for any indirect, incidental, or punitive damages. Our total liability is limited to the amount you have paid to PianoMode in the six (6) months preceding the claim. Indemnity: You agree to indemnify and hold PianoMode harmless from any claims, losses, or expenses arising from your use of the Site or breach of these Terms.


9. DISPUTE RESOLUTION: ARBITRATION & CLASS ACTION WAIVER

For Users in the USA:

  • Binding Arbitration: Any dispute relating to these Terms will be resolved through final and binding arbitration under the rules of the American Arbitration Association, rather than in court.
  • Class Action Waiver: You agree to bring claims against PianoMode only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

10. SEVERABILITY & MODIFICATIONS

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Modifications: We may update these Terms at any time. Your continued use of the Site after changes are posted signifies your acceptance of the updated Terms.

11. CORRECTIONS & SITE INTERRUPTIONS

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors.

  • Third-Party Content — Some embedded content (e.g., YouTube videos) is governed by third-party accessibility standards beyond our direct control.
  • Piano Games — Certain interactive games (Ear Trainer, Piano Hero, Note Invaders) are inherently visual or auditory in nature, which may limit accessibility for some users.
